Court rules against tyre makers

Retail Motor Industry loses High Court bid

The urgent interdict requested by the Retail Motor Industry (RMI) against the Recycling and Development Initiative of South Africa (Redisa) has been denied by the High Court and no interim relief was granted.

The application was found to be urgent but the court ruled that the RMI was not entitled to the interim relief and interim interdict for which it applied.

This means that all new tyre manufacturers and importers need to subscribe to, and all tyre dealers need to register with the Redisa plan by 21 September 2012 (that is 60 days after the plan’s publication by the Minister in the Government Gazette) and that the industry is therefore also legally obliged to deal with its waste.
